Terms of Service

1. General

These Terms of Service ("Terms") govern your use of modernvanity.ca (the "Website") and any purchases made through it. Modern Vanity is operated by BBS Flooring, a business registered in Ontario, Canada ("we," "us," "our").

By accessing the Website or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use this Website or place an order.

2. Products & Descriptions

We make every effort to accurately describe and photograph our products. However, actual colours may vary slightly from screen to screen. Minor variations in wood grain, finish texture, and stone patterns are natural characteristics of the materials and do not constitute defects.

Product specifications (dimensions, materials, included components) are listed on each product page. You are responsible for verifying that the product meets your requirements before ordering. See our Measuring Guide and Faucet Compatibility Guide for help.

3. Pricing & Payment

• All prices are listed in Canadian Dollars (CAD).
• Harmonized Sales Tax (HST) is calculated and applied at checkout as required by Ontario law.
• Prices are subject to change without notice. The price at the time of your order confirmation is the price you pay.
• Payment is processed securely via Stripe. We accept Visa, Mastercard, and American Express.
• Your order is not confirmed until payment has been successfully processed and you receive an order confirmation email.

4. All Sales Are Final

All sales on modernvanity.ca are final. We do not accept returns or exchanges for change of mind, incorrect sizing, or colour preference.

This policy exists because bathroom vanities are large, heavy items with significant shipping and handling costs. We encourage you to measure carefully, review our product specifications, and contact us with any questions before placing your order.

The only exception to this policy is for items damaged during shipping. See Section 5 for our damage claim process. Full details are also available on our Return Policy page.

5. Damage Claims

If your vanity arrives damaged, you may file a damage claim under the following conditions:

• You must inspect the vanity at the time of delivery, before the delivery driver leaves.
• If significant damage is found, refuse delivery and notify us immediately.
• Take clear photos of all damage from multiple angles.
• Contact us within 24 hours of the delivery attempt via WhatsApp at (647) 428-1111 or email at info@modernvanity.ca.
• Damage claims reported more than 24 hours after delivery, or damage caused during or after installation, will not be accepted.

Approved claims will be resolved via replacement or refund at our discretion. Refunds are processed to the original payment method within 5–10 business days of approval.

6. Shipping & Delivery

• We deliver within the Greater Toronto Area (GTA) only.
• Garage/driveway delivery: $140 CAD + HST. Inside delivery: $200 CAD + HST. Warehouse pickup: Free (by appointment).
• Delivery timelines are estimates (typically 2–3 business days) and are not guaranteed. We are not liable for delays outside our control.
• Someone must be present at the delivery address to receive and inspect the order.

7. Product Warranty

Our vanities are built with quality materials and are inspected before shipping. We do not provide a formal manufacturer warranty on assembled vanity sets at this time. Damage during transit is covered under our Damage Claims process (Section 5).

For hardware issues (hinges, drawer slides, handles) that arise within 30 days of delivery under normal use, contact us and we will work with you on a resolution.

8. Intellectual Property

All content on this Website — including text, photographs, graphics, logos, and page layout — is the property of BBS Flooring / Modern Vanity or its content suppliers and is protected by Canadian and international copyright laws.

You may not reproduce, distribute, modify, or create derivative works from any content on this Website without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by Ontario law:

• Modern Vanity (BBS Flooring) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your purchase, use, or inability to use our products or Website.
• Our total liability for any claim related to a purchase shall not exceed the amount you paid for the specific product in question.
• We are not liable for costs of installation, plumbing modifications, or any work performed by third-party contractors in connection with our products.
• We are not responsible for damage caused by improper installation, misuse, or failure to follow our installation and care instructions.

10. Indemnification

You agree to indemnify and hold harmless BBS Flooring, its owners, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Website, violation of these Terms, or misuse of our products.

11. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of the Website shall be resolved exclusively in the courts of Ontario.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

13. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with the "Last updated" date revised. Your continued use of the Website after changes are posted constitutes acceptance of the revised Terms.
